This is the agreement every attendee accepts during ticket checkout. It is reproduced here for your reference. By purchasing or holding a ticket to Badger Music & Arts Festival 2026, you agree to these terms.
BADGER MUSIC & ARTS FESTIVAL 2026
TICKET PURCHASE AGREEMENT, LIABILITY WAIVER & ASSUMPTION OF RISK
By purchasing a ticket to Badger Music & Arts Festival 2026 ("the Event"), you ("Participant") agree to the following terms and conditions:
1. TICKET TERMS
- All ticket sales are final. NO REFUNDS, NO EXCEPTIONS.
- Tickets are transferable. The new holder assumes all responsibilities under this Agreement.
- You must present valid government-issued photo ID at entry.
- Lost or stolen tickets will not be replaced.
- The organizers reserve the right to refuse entry or remove any person from the Event at their sole discretion.
2. ASSUMPTION OF RISK
The Event takes place at Badger Basin Recreation Area in Hartsel, Colorado at an elevation of approximately 9,000 feet. You acknowledge and voluntarily assume all risks associated with attending the Event, including but not limited to:
- High Altitude: Risk of altitude sickness, dehydration, and related medical conditions
- Extreme Weather: Exposure to extreme heat during the day, cold temperatures at night, sudden storms, lightning, high winds, rain, and dust
- Remote Location: Limited access to emergency medical services, hospitals, and cellular communication
- Terrain Hazards: Uneven ground, rocks, wildlife, and natural hazards
- Camping Risks: Fire hazards, equipment failure, and exposure to the elements
- Physical Activities: Dancing, walking on uneven terrain, and other physical exertion
- Loud Music: Exposure to high sound levels that may cause temporary or permanent hearing damage
- Other Participants: Actions of other attendees, including but not limited to negligent or reckless behavior
3. RELEASE OF LIABILITY
To the fullest extent permitted by law, you hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Badger Music & Arts Festival, its organizers, officers, directors, employees, volunteers, agents, sponsors, vendors, contractors, and the landowners/managers of the Event venue (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, while participating in, traveling to or from, or in any way connected with the Event.
4. INDEMNIFICATION
You agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any claims, lawsuits, costs, and expenses, including reasonable attorneys' fees, arising from your participation in the Event or your breach of this Agreement.
5. MEDICAL ACKNOWLEDGMENT
You confirm that you are physically and mentally fit to attend the Event, are not under medical advisement to avoid such activities, and have no conditions that would make your participation unsafe. You agree to bring adequate supplies of any required medications and to seek medical attention if needed at your own expense.
6. PHOTO/VIDEO RELEASE
You grant permission to the organizers and their authorized representatives to photograph, film, and record you and your likeness during the Event, and to use such images and recordings for promotional, commercial, or any other lawful purposes without compensation.
7. CODE OF CONDUCT
You agree to:
- Comply with all Event rules, regulations, and instructions from staff
- Practice Leave No Trace principles—pack out everything you pack in
- Treat other participants, staff, and the environment with respect
- Not bring prohibited items including illegal substances, weapons, fireworks, glass containers, or pets (service animals excepted)
- Not engage in vending or commercial activity without authorization
- Consume alcohol responsibly and only if of legal drinking age
8. EVENT CHANGES
The organizers reserve the right to modify the Event schedule, lineup, activities, or location at any time without notice. The Event may be canceled or modified due to circumstances beyond our control, including but not limited to weather, fire danger, public health emergencies, or government orders. In the event of cancellation, tickets will NOT be refunded but may, at the organizers' sole discretion, be credited toward a future event.
9. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Colorado. Any disputes arising from this Agreement or the Event shall be resolved exclusively in the courts of Park County, Colorado.
10. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
11. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the organizers regarding your attendance at the Event and supersedes all prior agreements and understandings.
BY CLICKING "I ACCEPT" BELOW, YOU ACKNOWLEDGE THAT:
- You have read and understood this entire Agreement
- You voluntarily agree to all terms and conditions
- You are at least 18 years of age, or have parental/guardian consent
- You understand that this is a legally binding contract
- You are giving up substantial legal rights, including the right to sue
- ALL SALES ARE FINAL AND NON-REFUNDABLE
