These Terms of Use (“Terms”) govern your access to and use of badgermusicfestival.com and related services operated by Badger Music & Arts Festival LLC (“Badger,” “we,” “us”). By using the site, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility
You must be able to form a binding contract to use the site. Certain features (such as purchasing tickets) require you to be at least 18 years old, or to have the consent of a parent or guardian.
2. Use of the site
We grant you a limited, non-exclusive, revocable permission to use the site for your personal, non-commercial purposes of learning about, applying to, and purchasing access to our event. You agree not to:
- use the site for any unlawful purpose or in violation of these Terms;
- scrape, harvest, or collect data at scale, or use bots or automated means except for legitimate search-engine indexing;
- attempt to gain unauthorized access to, probe, or disrupt the site, its servers, or other users’ use of it;
- circumvent security, access controls, or usage limits;
- upload malicious code or content that is unlawful, infringing, or harmful.
3. Intellectual property
The site and its content — including text, graphics, logos, the Badger name and marks, artwork, layouts, and software — are owned by Badger or our licensors and are protected by intellectual-property laws. Artist names, images, and marks belong to their respective owners. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
4. Submissions and applications
If you submit an application or other materials (for example artist, vendor, performer, volunteer, or theme-camp submissions), you represent that the information is accurate and that you have the right to provide it. You retain ownership of your materials, and you grant us permission to use them for the purpose of reviewing and administering your application and, if accepted, coordinating your participation. Do not submit confidential information you do not want us to use for these purposes.
5. Tickets and purchases
All ticket purchases are subject to our Ticket Purchase Agreement & Liability Waiver, which you accept at checkout. Among other things, all ticket sales are final and non-refundable. Prices, availability, lineup, and event details may change.
6. Third-party links and services
The site may link to or integrate third-party services (such as Stripe, Instagram, and interactive lineup tools). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.
7. Disclaimers
The site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, and we may modify or discontinue features at any time.
8. Limitation of liability
To the fullest extent permitted by law, Badger and its officers, members, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the site. Liability arising from the event itself is governed by the Ticket Purchase Agreement & Liability Waiver.
9. Indemnification
You agree to indemnify and hold harmless Badger and its personnel from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the site or your breach of these Terms.
10. Privacy
Your use of the site is also governed by our Privacy Policy and Cookie Notice.
11. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted, and your continued use of the site constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute relating to the site or these Terms will be resolved exclusively in the state or federal courts located in or serving Park County, Colorado.
13. Severability & entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Together with the documents they reference, these Terms are the entire agreement between you and Badger regarding your use of the site.
